Florida AG Argues Nonviolent Felons Shouldn’t Lose Their Gun Rights

Florida Attorney General James Uthmeier, with support from the National Rifle Association, is arguing that nonviolent felons should not lose their Second Amendment rights.

“My duty is to protect and defend the rights of the people as enshrined in our Constitution because those rights are nonnegotiable. As Attorney General, my commitment is to the people, no matter the cost,” Uthmeier said in a post on X.  . . .

During a traffic stop in 2022, [Christopher] Morgan told officers he had a gun in his car’s center console. He was charged with possession of a firearm by a felon. Morgan challenged the law as unconstitutional. After a trial court upheld his conviction, he appealed.

The state initially defended the conviction but changed course on Feb. 13, 2026. On March 18, Uthmeier filed a supplemental brief explaining the shift.

The brief leans on the Supreme Court’s text-and-history test, arguing that prohibiting gun ownership for nonviolent felons isn’t justified. It says Morgan, despite his felony, remains part of “the people” protected by the Second Amendment.

It also points to historical examples, noting that English, Founding-era, and Reconstruction-era laws only disarmed people who were demonstrably dangerous or posed a public safety risk. Uthmeier’s brief argues that a felony conviction alone shouldn’t automatically strip someone of their gun rights.

  8. I spent almost two years in the Mississippi penitentiary – the notorious Parchman Farm – 1972-73 for selling a half ounce of weed. Because I wouldn’t give them the name of the guy who gave me the weed. Turned 21 in prison and was a trustee when sentence ended, ironically allowed to carry a revolver. In the following years I got a degree, was employed in naval shipbuilding, commercial nuclear industry and as a federal contractor program manager. I also got my pilot’s license in 1985 and later instrument rating. I’ve owned planes since 1995 including the current one, a Mooney 201. Always told the truth on forms and applications and passed every FBI background investigation. Retired now 10 years. It is unconstitutional and unconscionable that I am barred from owning firearms. Period.

    1. I agree. Perhaps a time period after which the restrictions go away for non-violent felonies. I know in Texas a person “can be” charged with a felony offense for trespass with a firearm. It doesn’t happen often, but it’s still possible. I picture some hunter trailing a deer he legally shot on his lease or property and crossing onto the neighbor thinking “it’s gotta be close”. Dumb, but you can see where it might happen. Then suppose the anti-hunter neighbor gets video or catches them and demands full prosecution. Felony conviction. Lifetime loss of firearms ownership. Just ain’t right.

  9. In the interest of clarity, for a time I was a sworn deputy sheriff in Texas, and I am not a felon. However I agree with the assessment that non violent felons should be allowed to own firearms. Said felons should not be excluded from gun rights. They should be afforded the ability to defend themselves and their families.
