For over 90 years, the NFA has required that anyone interested in buying or building one of these weapons first submit an application to the ATF along with their fingerprints, a passport-style photo, and a $200 tax stamp before undergoing an enhanced background check. As the ATF notes, the $200 tax was “considered quite severe” in 1934 “to carry out Congress’ purpose to discourage or eliminate transactions in these firearms,” though it was never raised or adjusted to account for inflation. In today’s dollars, the figure would be well over $4,700.

But after January 1, 2026, those taxes will no longer be required for silencers, short-barreled firearms, or AOWs, making them significantly easier to obtain — jeopardizing public safety and resulting in an estimated $1.7 billion loss in tax revenue over the next decade.

The move is the latest attempt by the gun industry to chip away at the NFA. While NFA applicants previously had to be approved by the ATF and the chief law enforcement officers (CLEOs) in their areas, in 2016 — after lobbying from the National Shooting Sports Foundation (NSSF), the gun industry’s trade association — the ATF ruled that applicants only had to provide copies of their forms to CLEOs. The NSSF also lobbied for the ATF’s revamped “eForms” application system, which has led to dramatically faster approval times. …

Repealing the tax provisions may have been a backdoor attempt to invalidate the NFA. After the House passed the budget bill, GOA immediately announced that they were filing a lawsuit — dubbed the “One Big Beautiful Lawsuit” — along with the Silencer Shop, SilencerCo, Palmetto State Armory, and others to remove silencers and short-barreled firearms from the NFA, arguing that “once the tax is reduced to $0, the constitutional justification for the law collapses.”The NRA, ASA, Firearms Policy Coalition, and Second Amendment Foundation announced that they would file their own lawsuit challenging the constitutionality of the NFA. In a joint statement, the groups applauded Trump’s budget bill, which “serve[s] as a critical step towards our ultimate goal of dismantling the NFA once and for all.”

        So as long as they keep people burdened, they can “fight for them” (while actually accomplishing nothing for them, see any multi-decade Democrat-run city for examples).

          In 1853 the 13th Amendment abolishing slavery became part of the constitution – 100% of congress republicans vote in favor of it, 77% of congress democrats voted against it – it would take another 15 years after that for all slaves to be informed they were free people as the Democrat slave owners and Democrat politicians did everything they could to keep that from happening. Contrary to popular belief, all slaves back then were not blacks. Approximately 15% of the slaves in the southern states were poor whites forced into slavery or had sold their selves into ‘indentured servitude’ slavery, and around another 15% were (collectively) hispanic or Asian. There were some black slave owners as well that owned and sold slaves of all different races, and used ‘indentured servitude’ enslaved whites and other races for labor and other economic gain especially white women they used as prostitutes in brothels or ‘domestic home staff’ they ‘rented’ out to affluent families. But now all slaves were free, this did not set will with the democrats especially democrats in the southern states.

          Over time, democrats have tried for a resurgence of ‘slavery’ in one form or another, some slight and some more overt in their forms of submission and slavery. But overall, there has always been a part of the democrat party and democrat voters who long for the days of the plantation and the slaves that went with it. Today, these ‘slaves’ are also in the thousands of ‘left wing’ activists in the BLM and ‘No Kings’ and anti-ICE protests – ordered into action by their democrat affluent masters, black and white and hispanic, and their masters gain economically from it through the donations – just like the old plantation slave masters using their slaves for for financial gain.

          Democrats – 1853’s: “If the slaves are freed, who’s gonna pick our crops and clean our homes?”

          Democrats – 2025: “If we deport illegal aliens, who’s gonna pick our crops and clean our homes?”

This proves that they are admitting they don’t really care about the checks, taxes, etc.; they just want to stick it to gun owners.

  6. Let’s see: A $1.7 billion “loss” over a decade translates to $170 million per year. Divide that by $200 per tax stamp, and that comes to 850,000 such licenses being requested each year.

    Supressors, SBR, SBS, even AOW, have been in the hands of law abiding people, legally, for over 80 years since this NFA tax law went into effect.

    They have also been in the hands of criminals as well these many years.

    The NFA did exactly zero to keep ‘prohibited people’ criminals from getting them. It just taxed the law abiding and that was its purpose, ‘regulation of people rights’ by taxation. The NFA despite its name is not a firearms law, it was created by congress as a tax law and that was their specific intent by enacting it no matter the other hype about it, and SCOTUS has repeatedly affirmed over these many years its a tax law.

    And ya know who else has them? Law enforcement has them. An innocent person has an 8% chance of being accidently shot by law enforcement with these firearms (SBS/SBR) or any other firearm. An innocent person has a 0.003% chance of being accidently shot by a law abiding civilian with these firearms (SBS/SBR) or any other firearm.

    The cops and criminals already have theirs NFA tax free.

    Yes they belong in the hands of the law abiding people NFA tax free and NFA free. It does not say “…the right of the people to keep and bears arms, shall not be infringed if they pay a tax.”

    You are likely using one of the inflation calculators which uses the politically-influenced and famously “adjusted” government inflation rate. A more accurate comparison is to use historical gold prices: In 1934 the price of gold (per several historical gold price sources) was $35/oz. It looks like the price of gold today is somewhere around $3,316 per oz. $200 in 1934, converted to gold and stored in a buried box, and dug up today and sold, would be worth ($200 / $35 = 5.714, 5.714 * $3,316 = $18,947.62) about a tank of gasoline less than $19,000 USD.
