The Lie That Got Alex Pretti Killed on a Minneapolis Street

[I]n Minnesota, if you have a permit, you can carry a firearm. That’s absolutely true. But every concealed carry instructor in this state will tell you the same thing. The moment you choose to carry a firearm, your responsibility goes up, not down. You don’t become more entitled to engage in confrontation, you actually become more obligated to avoid it. 

Here in Minnesota, we have what’s called a duty to retreat. Which means if a judge later decides after the fact that you could have reasonably avoided a conflict, even if you felt threatened at the time, you can still go to prison for using your firearm. That’s not theory. That’s the real law here in this state. And anyone who teaches carry knows it. 

So, the idea that a carry permit somehow entitles someone to walk into an active area of federal law enforcement, get into a physical confrontation with armed agents, and then claim, “Well, I had the right to be there.” That’s not how any of this works at all. If anything, being armed creates an elevated duty to stay away from such volatile situations because now by doing that, you’re introducing lethal force into the environment, you’re increasing the perceived threat to officers and you’re dramatically narrowing their reaction window. Now, that’s not politics, that’s physics. …

Carrying a gun does not give you license to approach law enforcement and interfere with their duties. Filming does not give you license to defy lawful orders. And neither of those activities creates immunity from the consequences when things predictably escalate. 

And this is where context matters. Was this a peaceful sidewalk interaction or was this the middle of an enforcement operation? And the answer is obvious. 

Was this passive observation from a distance or physical proximity and confrontation? Was Pretti retreating or advancing? Those questions shape the case, not your slogans.

And here’s what bothers me about the way this is being framed. It trains people to think that their rights are shields from consequences instead of responsibilities. It tells them, “Well, just invoke the magic words, gun rights, press rights, protest rights, and reality will bend around you.” 

But it doesn’t. Reality responds to your behavior. Law evaluates your choices and actions. And officers in the field don’t have the luxury of freeze-frame hindsight. What they see is distance, movement, compliance, resistance, threat posture. And you have 100% control over all of those factors. You choose whether to approach. You choose whether to comply. You choose whether to resist. And you choose the posture and temperament with which you engage. All of which is relevant to whether you are exercising your rights lawfully or committing multiple state and federal crimes. …

So the conversation becomes dishonest if it only asks did Pretti have the right to do X instead of asking, did Pretti act in a way that someone with those rights is expected to act under the law. Because rights without responsibility aren’t liberty. They’re license for chaos. And when chaos meets armed law enforcement, people are likely to die.

If you want to carry, you must avoid confrontation. If you want to film, you must avoid interference with lawful operations. If you want to protest, you must avoid impedement. Those aren’t my political opinions. Those are the laws of our land. And pretending otherwise doesn’t honor Pretti, it endangers the next guy who thinks that some slogan will protect him from the predictable consequences of his actions. 

The tragedy here isn’t just what happened. It’s how people in influence are talking about it and what the public is inferring from those misguided and inaccurate comments. The public is being taught by far too many, you’re entitled to walk into danger. No, you’re obligated to stay out of it. And until we start talking about that part, we’re not talking about what actually matters.

    If he was perfectly within his rights to carry to fight off the cops he still wouldn’t have survived the encounter.
    If it was absolutely against every law for him to be there with a gun and he tried using it to fight off the cops he still wouldn’t have survived the encounter.
    This moron threw himself head first into a wood chipper for nothing. Worse than nothing: a feeble attempt to prevent the arrest and deportation of a woman beating illegal.

    The only aspects of this event that are worth discussion is the local cops doing nothing for crowd control and the local politicians stoking the flames of violent retardation as cover for their billion dollar grifting.

      He went there that day with the intent of creating confrontation and interfering and obstructing. In other words he went there with the intent to commit a crime. No matter how much these morons dislike what ICE is doing, the fact remains that the law they are enforcing is a good law and its a constitutional law and was enacted by congress, so you can’t just use the 1A or 2A as your excuse to act in a manner that is for a fact illegal – you can’t interfere and obstruct then yell “Its muh 1st amendment right to protest.” because its not protest, you can’t carry a gun into a protest activity with the intent or actions to interfere and obstruct then claim ‘Its muh 2nd amendment right – neither of these rights provide that one can use them to commit a crime. So yeah it matters, he had a responsibility to NOT do what he did and being armed imposed an even greater responsibility upon him to NOT do what he did and because he was irresponsible he created the conditions that led to his death.

      He was not some ‘peaceful protestor’ that happen to have been carrying a gun, he was not the ‘kind, ‘gentle, person they want to make him out to be – he was a very volatile and unstable person prone to emotional outbursts and violence (we saw this in the video of his attack on an ICE vehicle days prior to the day he was shot, completely volatile and unhinged and unstable, emotional outburst, violent). If he had been a peaceful protestor carrying a gun legally then everything would have been fine and he would probably be alive today. Had the Minneapolis police been doing their jobs as law enforcement instead of playing the game of their marx-ist socialia-ist mayor, and been there doing their jobs to quell any aberrant/violent behavior to keep things peaceful then he might be alive today. We can say lots of ‘this might or might not have happened’ stuff – but the fact remains that his actions created the conditions under which he lost his life.

      Aside from the guy actually carrying his gun illegally that day – illegally under Minnesota law, because Minnesota requires you to have your permit AND ID on your person when you carry and without that you are carrying illegally, Pretti had neither of these on his person. But as far as legally carrying a gun during protest – constitutionally, yes it is legal, and would have been under Minnesota law as well if you have your permit AND ID on you while carrying – AND – peacefully protesting. However, legal legitimate protest ends when your intent is to commit a crime or actually commit a crime and then it does not matter if you had a permit and ID on your person or not because then it becomes a ‘possession of a firearm in commission of a crime’ no matter if you used the firearm or not thus the carry in that case would have been illegal.

        I have my own questions about it, and I can see where others might also have questions. There are a lot of things pretty clear in the videos. But no matter what the feds did or did not do or what ever is said or not said – the fact remains that Pretti by his interference/obstruction activity created the conditions under which he lost his life.

    Ernesto Miranada was scum of the earth and should have been shot by a would be victim WELL before his arrest in 1963, but PPD was still wrong to beat a confession out of him. Pretti should have been sitting in a cell from his first confrontation, but Patel was still wrong to blame the 2A for officer behavior.

I guess the best way to sum up their complete shock and disbelief in learning their bad actions can have consequences instead of reward goes back to what the lesbian partner of Renee Good said that day she was shot by the ICE agent she was trying to run over with her car and that was “WHY DID YOU HAVE REAL BULLETS?!”

    Unfortunately, the white news media only photographed him from his backside. The newspapers never showed his face. And the photographs were in black and white, not color.

    You never spit on anyone. You never hit or kicked anyone. He never destroyed government or civilian private property.

    The most peaceful open carry protests have been by both Right and Left.

Look, all responsible 2A advocates, and concealed carry practitioners, should start with an understanding of a basic principle – you go out of your house ‘strapped’, and you are voluntarily assuming both greater risk, and greater responsibility. I choose to do it, because I think the benefit of having that handy if the SHTF outweighs the additional risk and responsibility, but I’m damn sure aware that I am taking on greater risk by doing so.

    And I am ultimately responsible for the consequences of my choices. Y’all can debate all the pros and cons of his decisions, the legality and/or constitutionality of his actions, the propriety of the LEO response ’til Flag Day, but . . . he made those choices. The choice to carry concealed (without his ID, which is not legal in MN). He chose to confront LEO in the process of a facially legal law enforcement action. MN also has a ‘duty to retreat’ doctrine, and he pretty much p*ssed all over that, multiple times, as the videos clearly show.
