Maybe NJ Should Focus on Putting Criminals Behind Bars Rather Than Skirting the Third Circuit’s ‘Assault Weapons’ Ban Ruling

While Politico is reporting that New Jersey Democrats are scrambling to “protect and expand the state’s firearm restrictions” after the Third Circuit Court of Appeals ruled the state’s ban on semiautomatic rifles is unconstitutional, the Citizens Committee for the Right to Keep and Bear Arms has a better idea: Stop trying to dance around court rulings and start trusting the citizens with their Second Amendment rights.

“New Jersey Democrats can no longer claim they’re just trying to protect the children or decrease crime,” CCRKBA Chairman Alan Gottlieb observed. “They’re obviously obsessed with restricting the rights of the citizens they’re supposed to be serving. Gov. Mikie Sherrill and her colleagues in the legislature need a refresher course in high school civics, because they can’t seem to understand that when a court declares a law to be unconstitutional, that law has always been unconstitutional, and they should stop trying to dream up ways to slither around the ruling.

“The Politico story mentioned a bill to mandate gun owners store their guns unloaded and locked inside their homes,” Gottlieb added. “That idea is already off the table, thanks to the 2008 Heller ruling, which Sherrill and her cronies evidently need to read again.”

Instead of cooking up more and different restrictions, Gottlieb suggested New Jersey lawmakers just get tough on criminals—especially repeat offenders—by locking them up for a very long time. People confined to jails and prisons aren’t on the streets committing robberies, assaults, burglaries, carjackings or homicides, he noted.

“What the Politico story reveals without really saying so is that Garden State Democrats are frustrated and furious the courts, and the Constitution, will not let them keep a regulatory stranglehold on the honest citizens of New Jersey,” Gottlieb said. “They’re just not taking this lesson to heart. The semi-auto ban, and the ban on original capacity magazines—which Democrats supported—have just been thrown out. There’s a lesson in that the Democrats are evidently just too stubborn to accept. They need to grow up, stop trying to be dictators, and acknowledge the right of the people is not subject to their petty personal prejudices against guns.”

I hesitate to suggest people leave NJ, NY, etc… because even though they’d be fleeing high crime, high costs, high oppression and high snackbar/yoot activity the majority of the clowns leaving will just bring the same politics and mindset that ruined their state with them and contribute to the ruin of their new home.

    When you have people who claim destroying women’s spaces is actually saving women’s rights, many of whom are women, or groups like “queers for Palestine” because a Christian not wanting to bake your cake is literal violence but a billion people in several countries that burn homosexuals alive, hang them in numbers for entertainment and toss them from rooftops is just beautiful diversity, those kinds of people are not going to leave their dissonance or mental illness behind. They’re bringing it with them to your state. To my state.

    Sane states need to be building walls, checkpoints and staging armed guards. Letting them in is a mistake. Don’t let your Rotary, Chamber of Commerce or any other local business orgs sucker you with stories of economic growth and financial boons. They’ll make money, sure. You’ll just have to suffer increased costs, population congestion and the proliferation of blue state mental illness.

    (Colion): “Montgomery County, Maryland just voted to ban concealed carry in parks, places of worship, and government buildings.

    And one of the councilmembers supporting it said the quiet part backwards:

    If you’re law-abiding, this won’t impact you at all.

    That is the entire problem.

    The law-abiding are the only people it impacts.

    The guy walking into a park to rob somebody does not care that the county council passed a new ordinance. He is already carrying a gun he is not allowed to have, into a place he is not allowed to have it, to commit a crime that was already illegal before this vote ever happened.

    Adding one more charge does not disarm him.

    It disarms the person who read the law and followed it.

    And the wildest part is one councilmember who voted against the bill accidentally explained exactly why this law falls apart.

    She asked how police would even know someone was carrying a concealed weapon unless they stopped and frisked them.

    That is the question.

    Because concealed means concealed.

    Either this law does nothing, or enforcement requires officers to start putting hands on people based on suspicion.

    So now Montgomery County has created a Second Amendment problem and a Fourth Amendment problem at the same time.

    You cannot say you are worried about people being stopped and frisked without cause while also supporting the law that creates the excuse to stop them.

    The Constitution is not an à la carte menu.

    You do not get to protect the Fourth Amendment while gutting the Second.

    Same document.

    Same people.

    Same protection.

    And this is not even Montgomery County’s first loss on this issue. Maryland’s highest court already struck down the county’s broader carry restriction earlier this year, so the council came back with a shorter list and the same basic idea.

    Get told no by the court.

    Trim the edges.

    Run it again.

    The result is simple:

    The only person guaranteed to be unarmed in that park, church, or government building is the person who follows the rules.

    The criminal ignores the sign.

    The law-abiding citizen obeys it.

    And that is how gun control works almost every time.”
