Banning Transgender Gun Ownership Isn’t Just a Terrible Idea, It’s Unconstitutional

Published reports that senior Justice Department officials are “weighing proposals” to limit transgender people’s Second Amendment rights is disturbing, the Citizens Committee for the Right to Keep and Bear Arms said in response.

“Prohibiting whole groups of people from owning and using firearms because a sick individual misused a gun to harm and kill children is as reprehensible as restricting the rights of all law-abiding citizens because some people have committed crimes,” said CCRKBA Chairman Alan Gottlieb. “That anyone in the Trump administration would consider such nonsense is alarming.”

Reports from CNN and others say the unidentified DOJ officials are considering the move in response to the shooting at the Annunciation Catholic Church in Minneapolis late last month. CCRKBA says such a blanket prohibition, affecting unknown numbers of people who have harmed nobody, is simply wrong.

“Gun owners already know what it’s like for the government to penalize them for crimes they did not commit,” Gottlieb stated.  “We shouldn’t even consider such an extreme response to heinous act committed by one disturbed individual, much less implement it, no matter how horrible the crime. The deranged Minneapolis killer is no longer a threat to anybody, and we needn’t make scapegoats of others who had nothing to do with that outrage, just to create the impression something is being done.

“The ironic aspect of this controversy,” he mused, “is that some in the liberal media are suddenly supporting gun rights because somebody in the Trump administration is talking about restricting transgenders from exercising their Second Amendment rights. Perhaps they will learn something from this.

“The government, no matter who is in charge, must understand that enumerated rights protected by the Constitution cannot be stripped away for what amounts to a publicity stunt,” Gottlieb said. “If we allow that to happen to one minority group, it could happen to another group, and then another, until the right becomes a distant memory, especially for those of us who have worked so hard to protect it. This is a bad idea, and it needs to go away immediately.”

The reason is because right now this is slipping through the cracks nationwide because of the way the left wingers and democrat politicians are creating ‘protections’ for those transgender. For example, the Minnesota trans shooter was ‘protected’ by laws in Minnesota from being ‘red flagged’ and prohibited from buying firearms in Minnesota because the democrats in Minnesota created laws and programs to cater to trans that keeps their diagnosed mental health illness issues records and diagnosis from being exposed.       Its also important to note this … People often think about ‘transgender’ as being male-to-female or female-to-male only. But that’s not true. There are actually three ‘classes’ of ‘transgender’, these are male-to-female, female-to-male, AND ‘non-binary’ identifying.

      ‘non-binary’ is the class of ‘transgender’ that is most often violent and most often with a diagnosis of mental illness. For example, since 30 June 2025 there have been more than 38,000 ‘non-binary’ identifying people arrested nationwide for violent crimes (collectively, robbery to assault to rape to murder) with a firearm or other weapons. That’s just a glimpse of a couple of months period – if we include the violent trans people (all three classes – not all trans people were violent in this) participation nationwide in the ‘no kings’ thing and the trans violent attacks and trans mass-shooting attack on law enforcement and an ICE facility, and the trans murder cult, and the violent trans actions in public places and other protests, and the Trantifa actions and their vows to murder biological women to abduct their children and forcibly convert them to an opposite gender with drugs and surgery, and the thousands of trans people on line screaming for the death of more innocent children especially ones in religious schools, then take into account the trans school-shooters, then take into account that the vast majority (more than 90%) of violence against trans is trans-inter-community from trans (we know this from thousands of police reports on ‘domestic violence’ in the ‘trans community’) – we begin to see a bigger picture of a very violent trend from trans numbering in the multiple thousands just this year to date alone and in the past and that is not the picture of great mental health. But all of it is ‘protected’ and sidelined by liberals and democrat politicians and LGBTQ+ adherents in attempts to down play it or hide it. It has become ‘unique’ as a blatant display, as an active and blatant threat, that deserves some attention that’s unique to it. No matter how you want to say it, contrary to the hype that ‘trans’ is not violent and is somehow ‘normal’ – their own ‘community’ has shown that it is violent and not normal and is a threat to society and even to their own ‘trans community’ and this is the very picture of violent mental illness.

      The democrats and anti-gun wanted what the Trump DOJ is doing – didn’t they scream for ‘common sense’ gun control in regards to mental illness, it was even one of the democrat sponsors of the Bipartisan Safer Communities Act that said that 100% of mass-shooters are mentally ill – but now suddenly when one of the broken toy’s the democrats and liberals created with ‘gender ideology’ kills – they become all about protecting trans – then when the ‘trans community’ (as mentioned above) is visibly and actively expressing violence – that want to say ‘oh no, its not mental illness …its society fault…’ – then because the Trump DOJ is seeing the overall picture of the vast scope and uniqueness of this trans violence mental health illness and thinks something should be done, just like the democrats and anti-gun were crying for in their wanting to address mental illness in terms of gun control…suddenly the anti-gun and democrats are crying foul ’cause trans.

      Frequently we see the LGBTQ+ community claim that transgender people are less likely to be violent, they will point to stats and all sorts of things – but its a smoke and mirrors trick, in reality they are are only including two ‘classes’ of transgender, male-to-female or female-to-male (and even slanting the facts there also) and deliberately leaving out the ‘non-binary’ in their ‘not violent’ claim. When we look back over the years we see a definite trend of ‘transgender’ committed violence (some of it from the male-to-female, female-to-male types but mostly in the non-binary), and in 2020 after Biden was elected we see a sudden increase of more than 300% over the Biden era as democrat politicians aided and facilitated more radicalization by promoting false claims of ‘trans genocide’ and ‘MAGA going to put them in trans concentration camps’, but usually its not until one of the male-to-female or female-to-male types does something that makes it into the news we see the effect of that radicalization. The majority of the trend is in the ‘background noise blanket’, hiding it from the public at large, created by the left wing media not covering it or the laws or policy in a state or city preventing law enforcement from citing publicly or in stats that a criminal was ‘non-binary’ and the deceptive use of ‘stats’ by the LGBTQ+ community.

When we include just ‘violence’ from trans (just including suicide – about ~42% actually for this time frame – which is self-harm violence and inter-community trans-on-trans violence) for 2021 – 2025 … its ~ 58% of the trans-community is violent. (note: this is not including the very public displays of violence from trans involved in BLM and no-kings and other protests, nor is it including the various trans ‘groups’ advocating and calling for violence – if those are included for this time frame it makes about ~75% of the trans community violent. Collectively, in just terms of ‘violence’, all this together (including the trans killers in this time frame) (or just the suicide/trans-on-trans inter-community standing alone) makes the trans community the most violent demographic in the country.)

          When the trans community says ‘we are not violent people’ – well, you can apply what ever spin you want, but the trans community is full of violent people.

    “FBI Director Kash Patel said the FBI prevented a potential mass shooting at a preschool after agents arrested a man who allegedly posted threatening messages online.

    Writing under the username ‘CommentatorsHateMe,’ Zachary Charles Newell allegedly posted a comment on YouTube indicating his intention to ‘shoot up’ a preschool and kill black children.

    According to the complaint, that was not the only instance of Newell allegedly writing threatening and racist posts.

    Google LLC reported the threats to the FBI’s National Threat Operations Center on Aug. 31, having linked the “CommentatorsHateMe” account to an email registered to Newell, with associated phone numbers and an address.

    Law enforcement traced the account’s IP address to Charter Communications in Newport, and on Aug. 31, Carteret County Sheriff’s Office deputies confronted Newell at his home.

    Newell allegedly admitted to making the YouTube comment, according to the complaint.

    A search warrant was executed at his home, and he was initially charged in state court with communicating a threat of mass violence on educational property.

    The Carteret County Sheriff’s Office told Fox News Digital Newell was given a $30,000 bond by a state magistrate, where he was able to post bond.

    Later that evening, the sheriff’s office worked with the FBI to take him into federal custody on federal charges. Additional charges will be forthcoming by the FBI.

    If gender dysphoria is a gun-prohibiting mental illnesses, then so is PTSD, post-partum depression, plain old depression, and anything else you want to include. At best, you will discourage every gun owner from seeking treatment that they may need. At worst, you’ll pack the prisons with non-criminal gun owners.

      That’s not true. Trump is talking about the law, those that have been, like the law says, ‘adjudicated’ mentally ill. Simply having gender dysphoria is not ‘adjudicated’ as having a mental illness. The can still seek treatment from mental health professionals and its not an adjudication. This is about those adjudicated with mental illness, currently that is being hidden from being disclosed by dem and liberal laws and programs catering to trans.

      So that’s the ban being talked about, exposing those trans allowing the law to be applied just like its applied to non-trans now.

      Its what the dems have been wanting and apply to non-trans in blue states now, only they have been not applying it to trans. Why should adjudicated trans mental illness not be included too?       This is a false comparison argument that’s frequently put forth by LGBTQ+ orgs in different contexts to distract from the ‘gender dysphoria’ to make it seem some how ‘normal’ in the main stream.

      gender dysphoria is not like PTSD, post-partum depression, plain old depression.

      ‘gender dysphoria’ is part of the constellation of constructs called ‘gender identity’. Basically, in science (all disciplines including medical), a ‘construct’ is something that is created from distorting or rearranging something else in some way because what you are trying to create does not exist in reality. The existence of a ‘construct’ does not mean its organic reality. For example, a physically normal human person who has a ‘gender identity’ of being non-binary – that is a construct that does not exist in reality, in their minds they have distorted the reality to create their own self-view of non-binary when the reality is for a physically normal human person there are either male or female. As a comparison to an organic reality, for example, plastic is a ‘construct’ – its made from rearranging chemical compounds such as ethylene and propylene, polymerizing them, to form long chains of molecules that from the ‘plastic’ we make thing from – ‘plastic’ is not an organic reality, there are no ‘plastic trees or plants from which we harvest ‘plastic’, but on the other hand the crude oil and natural gas that is refined to form the ethylene and propylene is organic reality as is, for example, the rain water that falls from the sky during a storm.

      ‘transgender’ consists of three main categories (classes), these are male-to-female, female-to-male, and ‘non-binary’ identifying – it is not an organic reality. Each of these has created a construct of their gender identity, a construct that distorts the reality of their sense of gender. For a basic example, male-to-female trans say they ‘feel’ like they are female so want to be female instead of the male they are biologically – they have distorted the reality of the biological fact (the organic reality) of being male by suppressing it to create the construct they feel like female and want to be female, so they do the drugs and surgery in an attempt to create that construct but the organic reality is they are biologically male so in biology their ‘physical manifestation’ of their construct, although maybe pleasing to them, is not the organic reality that they are male biologically.

      In other words, ‘gender dysphoria’ is a distortion of ‘gender identity’ to create something that in reality does not exist. ‘gender dysphoria’ is not actually a primary symptom – it is a secondary symptom that (for the vast majority of trans) masks a deeper more serious mental illness issue or issues. Basically, because its not a primary symptom its called a ‘disorder’ (of distress) – but its still a mental illness, a part of a deeper more serious mental illness issue or issues.

      The more serious mental illness issue or issues is why the suicide rate is 40% in the trans community and why ‘domestic violence’ incidents are so high in the ‘trans’ community and depression rates (usually leading to suicide) are so high in the trans community. The deeper mental health issue is never addressed and the result from not being addressed means there are basically a lot of ‘ticking time bombs’ out there waiting to lash out either by breaking down completely at some point or commit violent acts either against their self or someone else. The trans community likes to blame all this, in some way or another, on ‘society’ – ‘oh, if you will just give us trans rights we will be fine’, ‘oh, if you will stop misgendering us we will be fine’, ‘oh, if you will just let us use a restroom that matches the gender we say we are it will make everything ok’. This is the same ‘argument’ they presented to justify their trans, ‘oh, just let me be the gender I think I am and everything will be ok’ – the reality is its never ok with (the vast majority of) them. It wasn’t ok after they had the drugs and surgery, it wasn’t ok after they started claiming to be ‘non-binary’, ‘it wasn’t ok when they lived as and dressed as their claimed gender’ – it wasn’t ok because they started to view the world through the eyes of a construct that wasn’t reality and demanded the world conform to and accept their construct and leave actual reality behind to please them. Trans will never be the organic reality they want to identify as, they will always be a construct of something that does not actually exist – they may be ‘physically’ here but their construct will always be just that, a construct and not organic reality no matter how they view themselves or how loud they scream about it and somewhere inside them there is probably something that reminds them of this and it really makes them angry but on the other hand there are some trans who have come to terms with it and go on with their lives.

      PTSD, post-partum depression, plain old depression are not like ‘gender dysphoria’ at all. Each of those, the PTSD, post-partum depression, plain old depression are grounded in the reality that there is a cause for them – they were not created from a distortion of something to create something that does not exist.

  5. The mentally ill have been prohibited from buying and possessing firearms since 1968. This prohibition has been upheld in its most recent court test at the Appeals Court level, known as “Tyler II’ (Tyler v. Hillsdale County Sheriff’s Dept., Case No.13-1876, 6th Circuit). This 2016 test is post McDonald and post Heller. It precedes Bruen.

    The mental health care community in the United States refuses to commit the mentally ill or find them mentally defective, so the 1968 Gun Control Act’s attempt to keep guns out of the hands of mentally ill people:

    United States Code, Section 922(d):

    “It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person, including as a juvenile—”
    (4) has been adjudicated as a mental defective or has been committed to any mental institution at 16 years of age or older;

    simply does not work. AG Bondi is only expressing support for the terms of current federal (and most state) law, the position you would expect your Attorney General would take. It is unfair and reckless to demand that Attorneys General substitute the current political fashion for the actual law.

    The mental health care community would probably become more cooperative at identifying mental defectives if the various bans on the mentally ill were reversible, which in practice, in the case of firearms bans, they are not. The mental health community anguishes over “stigmatization” and somehow believes that all the mentally ill can be restored with “proper treatment”. So they refuse to support involuntary commitment and/or designation as mentally defective without a clear rehabilitation process.

      But to answer your question, no the 4473 does not ask you if you have a mental illness….it asks you if you have been adjudicated mentally defective. Words have meanings and are important. Ottherwise anyone who has seen a doctor for depression, PTSD or other “somewhat” common dissorder could be barred from the 2A.

      I do agree that pot should not be a disqualifier…but legally it might be.

        That’s not correct because in reality the 4473 does ask about ‘mental illness’ as this is what “adjudicated as a mental defective” means…. (See 18 U.S.C. §§ 922(g)(4) and 924(a)(2). The terms enumerated below are located in 27 C.F.R. § 478.11.)

        “A person is ‘adjudicated as a mental defective’ if a court, board, commission, or other lawful authority has made a determination that a person, as a result of marked subnormal intelligence, MENTAL ILLNESS, incompetency, condition, or disease:

        Is a danger to himself or to others;
        Lacks the mental capacity to contract or manage his own affairs;
        Is found insane by a court in a criminal case; or
