Everyone may assume that Rare Breed simply wants to eliminate competing products from the market? However, what if they want to consider offering licensing, albeit at a significant royalty? Or what if they want to use it for cross-licensing opportunities with other major firearms manufacturers that might have patents that interest Rare Breed? Should Rare Breed’s patent be upheld, this expressed ATF policy objective would rob Rare Breed of these opportunities to monetize the value of their patent via licensing or the manufacturing and sale by them of products that incorporate cross-licensed patents.

“Patent owners have rights. Federal agencies have authority. Courts have jurisdiction.”

Federal agencies always have Power, and only sometimes Authority. They frequently overstep their authority while exercising (abusing) their power.
